Legislation

The obligation to provide employees with protective drinks in the workplace is based on government regulations and OSH directives. A protective drink to protect against heat stress shall be provided in an amount equivalent to at least 70 % of the fluid and mineral loss through sweat and respiration over an eight-hour shift. The hygienic limit for fluid loss in heat stress shall be 1,25 litres per eight-hour shift. A protective drink to protect against cold stress shall be provided warm, in quantities of at least half a litre per eight-hour shift.

Parameters are set for each job class, in particular the workplace temperature from which protective drinks must be administered (e.g. heavy industry workers 26 °C, clerical workers 34 °C). The regulation also addresses work in low temperatures, with workers being provided with at least half a litre of hot drink per eight-hour shift.

Legal resources on protective drinks

Act No. 262/2006 Coll., the Labour Code; Act No. 309/2006 Coll., regulating other occupational health and safety requirements; Government Regulation No. 361/2007 Coll., laying down conditions for occupational health protection; For the above reasons, the protective drink is a tax deductible expense!

Example of calculating the amount of protective drink

  • The employee works as a semi-automatic machine operator, his job is classified as Class IIIa, and the workplace was 25 °C on a particular day.
  • According to the table, the range in °C for working class IIIa is 20 to 29 °C, a difference of 9 °C
  • Fluid replacement for the above range is 0.9 to 2.8 litres, a difference of 1.9 litres
  • 1.9 : 9 = 0.21 litres/1 °C
  • 25 – 20 = 5 °C
  • Fluid replacement for an eight-hour shift = 0.21 x 5 = 1.05 + 0.9 = 1.95 litres = 2 litres.
